IRL under DS 44 what it must say and when it is delivered

Occupational risk information (IRL) is what each person must know about their position before starting work under Chile's Supreme Decree 44: its risks, how they are controlled and how to work safely. Here is the minimum content of article 15, when it is repeated and a sample format.

Informational guide, not legal advice. Check the current regulation at Ley Chile (Chile's official law library) and consult your safety professional or your mutual insurer (mutualidad).

What it is

The IRL replaced the ODI of DS 40

The ODI, the duty to inform under DS 40, was repealed by DS 44 as of February 1, 2025. Its article 15 replaces it: the information is no longer a generic list; it is determined from the risk matrix and the preventive program.

Before starting and every time the work changes. Until the matrix and program are ready, the risks inherent to the activity are communicated (art. 15).

According to the Labor Directorate (DT), it can be delivered through the prevention department, the joint safety committee, the internal regulations or a document made for that purpose.

The IRL comes from the matrix: start there

The risks and measures for each position in the IRL are those of the risk matrix. The IPER matrix template organizes them by process, task and position; it is not an IRL format.

  • · Probability times consequence using the method of Chile's Public Health Institute (ISP): expected loss value (VEP) and level calculated and color-coded
  • · Controls in the order of article 9, from elimination to PPE, recording the highest control used
  • · Owner, deadline, status and next annual review, ready for the preventive program
  • · Alerts for high risks controlled only with PPE, rows without a control and overdue deadlines

It does not replace an expert assessment or the Chilean Ministry of Health (MINSAL) protocols.

Frequently asked questions

DS 44 IRL FAQ

What is the IRL under DS 44?
It is the occupational risk information (información de riesgos laborales) of article 15 of Chile's DS 44: what the company must tell each person before they start work about the risks of their tasks, the preventive measures and the correct work procedures, determined from the risk matrix and the preventive work program.
What is the difference between the IRL and the ODI?
The ODI was the duty to inform under Title VI of DS 40, added by DS 50 of 1988. DS 44 repealed DS 40 as of February 1, 2025 and replaced it with the IRL, whose content is no longer a generic list: it comes from the risk matrix and the preventive program.
When is the IRL delivered?
Before the person starts work, and again each time they join a new production process or the technologies, materials or substances they use change (art. 15).
What must the IRL contain?
At a minimum: the features of the workplace (space, environmental conditions, order and cleanliness, machines and tools), the risks and their measures, including those for emergencies and disasters, the safe work procedures and the characteristics of products and substances according to their safety data sheet.
Is there an official IRL format?
DS 44 does not set a format. The Labor Directorate (DT) states that the information can be delivered through the prevention department, the joint safety committee, the internal regulations or a document prepared for that purpose. Mutual insurers provide formats to their member companies.
Does the IRL have to be signed?
Article 15 does not say so literally. Article 72 does require all preventive management to be recorded in reliable documentary form, preferably electronic. That is why it is common practice to record delivery with the date, name and signature of the person receiving it.
What if the company does not have a risk matrix yet?
While the matrix and program are pending, article 15 requires informing the risks inherent to the activity being performed. Once the matrix is ready, the IRL is updated with what it determines.
