DS 44: the records it requires and how to keep them
Informational guide, not legal advice. Check the current regulation at Ley Chile (Chile's official law library) and consult your safety professional or your mutual insurer (mutualidad).

What it is
DS 44 replaced DS 40 and DS 54
Supreme Decree 44 of Chile's Ministry of Labor is the regulation on preventive management of occupational risks. It was published on July 27, 2024, has been in force since February 1, 2025, and repealed DS 40 and DS 54 of 1969.
What used to be the ODI (duty to inform) is now the occupational risk information (IRL) of article 15.
What it requires
The records DS 44 requires, article by article
Everything starts with the risk matrix and ends in article 72: preventive management is recorded in reliable documentary form, preferably electronic, available to inspectors.

The formats
The 15 formats in SUSESO Annex No. 62
For article 72, the SUSESO circular (Chile's Social Security Superintendency) instructs mutual insurers to provide a record-keeping system with at least these formats. The third column shows where we explain each one.

Risk matrix
The IPER risk matrix in a 3 × 3 table
Consequence (1 · 2 · 4)
Probability 2 × consequence 4 = Expected loss 8 · Significant. Do not start the work until the risk is reduced.
For safety risks, the guide from the ISP (Chile's Public Health Institute) uses the expected loss value (VEP): probability times consequence, each rated 1, 2 or 4. Tap a cell to see what to do at that level.
How it is done today
5-minute talks and the joint committee: on paper and spreadsheets
The talk was given, but a signature is missing and the sheet sits in a binder. The committee agreed on three actions and one went overdue without anyone noticing. The problem is rarely the format: it is keeping the record up to date.
- Talks: not mandatory under that name; they reinforce the IRL and training (arts. 15 and 16).
- Joint safety committee: mandatory above 25 workers; meets once a month.
